Though AHPs in Doubt, Some are Moving Ahead

After a March court ruling questioned the legality of Association Health Plans (AHPs) as an "end-run around the Affordable Care Act," many have questioned their future. Some groups, however, are moving forward with plans as is.

Since the Federal government has yet to seek a stay of the judge's order, many of these plans are currently not legal. In any case, some have openly wondered if state regulators will actually enforce the restrictions on any newly formed AHPs.

“These plans are not an end run around the ACA,” attorney Christopher Condeluci, who represents several such plans, told Employee Benefits News. He believes that while the states that brought the challenge are expected to enforce the ruling, some other states support broader access to AHPs.

We will monitor this closely in Tennessee, as some AHPs have begun to form.
